1. Scope of the Service<\/strong><\/h2>

ArtCheck provides documentary provenance verification services for works of art and cultural property.<\/p>

All services are provided by:\u2028ArtCheck di Luca Sasdelli<\/strong>\u2028Registered in Spain \u2013 NIF: Y9200895N<\/p>

The service consists of consulting public databases, institutional archives, and official sources accessible at the date of analysis, and issuing a Provenance Verification Report<\/strong> reflecting the documentary findings available at that time.<\/p>

2. Nature of the Service<\/strong><\/h2>

The Provenance Verification Report:<\/p>

  • does not constitute a certificate of authenticity<\/li>
  • does not attest legal title<\/li>
  • does not represent an export license<\/li>
  • does not authorize commercialization<\/li>
  • does not replace legal, tax, customs, or regulatory compliance verification<\/li><\/ul>

    The service is strictly informational and documentary in nature.\u2028ArtCheck is a private verification service and does not exercise investigative, regulatory, or public authority functions.<\/p>

    3. Information Provided by the Client<\/strong><\/h2>

    The client undertakes to provide accurate and complete information, including:<\/p>

    • description of the artwork<\/li>
    • images<\/li>
    • dimensions<\/li>
    • identifying numbers<\/li>
    • provenance documentation<\/li>
    • any relevant supporting material<\/li><\/ul>

      Where information is incomplete or insufficient, ArtCheck may suspend or terminate the request without refund.<\/p>

      4. Commencement and Performance<\/strong><\/h2>

      The service shall commence only after:<\/p>

      • acceptance of the quotation<\/li>
      • advance payment of the agreed fee<\/li><\/ul>

        Completion times depend on case complexity and availability of sources.\u2028The outcome is communicated exclusively through issuance of the Provenance Verification Report.<\/p>

        5. Specialist or Extended Services<\/strong><\/h2>

        If elements arise requiring additional research, legal review, or specialist assessment, such services may be offered under a separate written agreement and fee arrangement.<\/p>

        6. Limitations of Sources<\/strong><\/h2>

        Results reflect only the information available in the consulted sources at the date of analysis.<\/p>

        Not all losses, thefts, or claims are reported or recorded.\u2028The absence of records does not constitute proof of lawful provenance.<\/p>

        ArtCheck shall not be responsible for omissions, inaccuracies, delays, database errors, or subsequent updates made by third-party sources.<\/p>

        7. Fees<\/strong><\/h2>

        Fees are agreed prior to commencement and must be paid in advance.<\/p>

        Any additional services require separate approval and fee agreement.\u2028All applicable taxes, duties, or transaction charges are borne by the client.<\/p>

        8. Confidentiality<\/strong><\/h2>

        Information received from the client is treated as confidential and used solely for the requested verification.<\/p>

        Disclosure may occur only where required by applicable law or strictly necessary in connection with a potential alert.<\/p>

        9. Intellectual Property<\/strong><\/h2>

        All materials provided by the client remain the client\u2019s property.<\/p>

        The client authorizes ArtCheck to use images and descriptions solely for purposes related to the documentary verification service.<\/p>

        10. Client Representations<\/strong><\/h2>

        The client represents and warrants that:<\/p>

        • they have lawful possession of the artwork or a legitimate interest in requesting verification<\/li>
        • all information provided is accurate and complete<\/li><\/ul>

          ArtCheck relies on the information supplied by the client.<\/p>

          11. Limitation of Liability<\/strong><\/h2>

          ArtCheck performs its services with professional diligence and in good faith.<\/p>

          However:<\/p>

          • ArtCheck does not guarantee the completeness of external databases<\/li>
          • does not guarantee the absence of unrecorded events<\/li>
          • does not guarantee the absence of future claims<\/li><\/ul>

            To the fullest extent permitted by applicable law:<\/p>

            ArtCheck\u2019s total aggregate liability arising out of or relating to a specific verification service shall be strictly limited to the amount actually paid by the client for that specific service.<\/p>

            Under no circumstances shall ArtCheck be liable for:<\/p>

            • indirect damages<\/li>
            • consequential losses<\/li>
            • loss of profit<\/li>
            • loss of opportunity<\/li>
            • reputational damage<\/li>
            • business interruption<\/li>
            • decisions made by the client or third parties in reliance on the Report<\/li><\/ul>

              12. Force Majeure<\/strong><\/h2>

              Events beyond the reasonable control of ArtCheck, including technical disruptions, database unavailability, or governmental measures, may delay or prevent performance without liability.<\/p>

              13. Amendments<\/strong><\/h2>

              ArtCheck reserves the right to update these Terms and Conditions.<\/p>

              The version published on the website at the time of service request shall apply.<\/p>

              14. Governing Law and Jurisdiction<\/strong><\/h2>

              These Terms and any dispute arising out of or relating to ArtCheck services shall be governed by the laws of Spain<\/strong>.<\/p>

              Any dispute shall be subject to the jurisdiction of the competent courts of Spain, unless otherwise agreed in writing.<\/p>

              15. Severability<\/strong><\/h2>

              If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.<\/p>
