FAQ – ArtCheck Provenance Verification
The following information clarifies the nature, functioning, and limitations of the documentary provenance verification service provided by ArtCheck.
What does ArtCheck do?
ArtCheck performs documentary provenance verification of works of art and cultural property. Through the consultation of archives and databases accessible at the date of analysis, it verifies the possible existence of records relating to theft, loss, or other relevant alerts.
The outcome is provided in a Provenance Verification Report.
Does ArtCheck verify the authenticity of an artwork?
No. The service concerns documentary provenance only. It does not include attribution analysis, expertise, authenticity certification, or technical evaluation.
Is the service part of due diligence?
Yes, it may form part of a broader due diligence process. It does not replace legal, tax, customs, or authenticity checks.
Who can request a verification?
Collectors, galleries, auction houses, foundations, insurers, and art market professionals with a legitimate interest.
What information is required?
For an effective verification, it is recommended to provide:
- artwork description
- images
- labels, stamps, or identifying numbers
- available provenance documentation
The verification is performed based on the information provided.
What happens if a match is found?
The requester is informed. Further steps or contact with relevant entities may be suggested.
ArtCheck does not exercise any control or claim over the artwork.
Does ArtCheck automatically report to authorities?
No. ArtCheck is a private operator and not a public authority.
Any communication may occur only where required by applicable law or strictly necessary in connection with a potential alert.
Does the Report guarantee that the artwork is not stolen?
No. The Report reflects only the information available in the consulted sources at the date of issuance.
The absence of records does not constitute proof of lawful provenance.
Does the Report have a validity period?
Yes. The verification reflects the situation at the date of issuance. Subsequent updates in databases may change the overall picture.
Can an updated verification be requested?
Yes. A new updated verification may be requested. Such update constitutes a separate service.
Can the Report be used in legal contexts?
The Report is a technical document reflecting the outcome of documentary verification.
It may be used as an informational element in due diligence processes or professional contexts.
It does not constitute legal advice, proof of ownership, an administrative act, or a judicial decision.
Does ArtCheck guarantee the absence of future risks?
No. ArtCheck performs its services with professional diligence but cannot guarantee:
- the completeness of databases
- the absence of unrecorded events
- the absence of future claims
What is ArtCheck’s liability limit?
To the extent permitted by applicable law, ArtCheck’s total liability is limited to the amount actually paid by the client for the specific verification.
ArtCheck shall not be liable for:
- indirect losses
- consequential damages
- loss of opportunity
- reputational damage
- decisions made by the client or third parties based on the Report
Can a request be cancelled or refunded?
The verification process starts after payment confirmation. Once documentary research has begun, refunds are generally not available.
Any specific conditions are defined in the terms accepted at the time of request.
How is confidentiality ensured?
All information provided is treated as confidential and used solely for the requested verification.
It may be disclosed only where necessary or required by applicable law.
Which law governs the service?
All services are provided by:

The service is governed by the laws of Spain. Any disputes shall fall under the jurisdiction of the competent courts of Spain, unless otherwise agreed in writing.
