ArtCheck – Operational Policy
1. Identity and Scope
ArtCheck is an independent documentary provenance screening service operating under a structured and transparent operational framework.
All services are provided by: ArtCheck di Luca Sasdelli Registered in Spain – NIF: Y9200895N
ArtCheck performs documentary screening of works of art and cultural property for informational and risk-assessment purposes. The service is limited to documentary verification based on information available at the date of analysis.
ArtCheck does not operate as a public registry nor as a proprietary stolen-art database.
2. Nature of the Screening
The screening process may include:
- consultation of relevant public and institutional databases
- review of accessible archival and documentary sources
- verification of reported thefts, losses, alerts, or claims
- consistency review of identifying data provided by the client
ArtCheck independently determines which sources are appropriate and proportionate to the requested level of service.
3. Structured Certification
Upon completion of the screening, ArtCheck issues a numbered Provenance Screening Certificate.
The Certificate:
- identifies the artwork based on submitted information
- states the date of verification
- reflects documentary findings available at that date
- references this Operational Policy
The Certificate is valid exclusively as of the date of issuance.
ArtCheck certificates are documentary attestations of screening activity and do not constitute legal title confirmation or authenticity certification.
4. Methodological Framework
ArtCheck operates under an internal methodological structure designed to ensure consistency, traceability, and documentary integrity.
The screening reflects the documentary landscape accessible at the time of verification. ArtCheck does not guarantee the completeness of external databases or the existence of undisclosed or non-public claims.
5. Limitations
The service:
- does not certify authenticity
- does not confirm legal ownership
- does not replace legal due diligence
- does not constitute export authorization
- does not substitute regulatory or customs compliance procedures
Absence of records does not constitute proof of lawful provenance.
6. Extended Services
Where higher-level analysis is required, including legal risk assessment, provenance reconstruction, or legal review, such services are provided only under separate written engagement.
7. Confidentiality
All information and documentation provided by the client are treated as confidential and used solely for the requested screening.
Disclosure may occur only where required by applicable law or competent authority.
8. Fees
All services are subject to advance payment.
Additional or extended services require separate agreement and fee structure.
9. Limitation of Liability
ArtCheck performs its services in good faith and with professional diligence.
To the fullest extent permitted under applicable law, ArtCheck shall not be liable for:
- indirect or consequential losses
- economic or reputational damages
- decisions taken by clients or third parties based on the Certificate
The Certificate reflects documentary findings at the time of issuance only.
10. Governing Law and Jurisdiction
All services are governed by the laws of Spain.
Any dispute arising in connection with ArtCheck services shall be subject to the jurisdiction of the competent courts of Spain, unless otherwise agreed in writing.
11. Updates
ArtCheck reserves the right to update this Policy periodically.
The version published at the time of the service request shall prevail.
